NYC DOB Issues Notices of Deficiency for Local Law 152 Gas Piping Inspections

If you own or manage a building in New York City, you may soon be receiving a Notice of Deficiency (NOD) from the Department of Buildings (DOB). On September 26, 2025, the DOB announced that it will be issuing NODs this fall to property owners who failed to file the required Gas Piping System Periodic Inspection Certification (GPS2) for Cycle 1 of Local Law 152 inspections.

These notices affect buildings not classified in Occupancy Group R-3 (one- and two-family homes are exempt). The NODs will specifically apply to buildings in Cycle 1, Sub-cycles B and C, whose GPS2 filings were not submitted by the deadlines.

 

What Does a Notice of Deficiency Mean?

  • Action required: The NOD will remain open until a valid Cycle 2 GPS2 certification is submitted or a challenge request is approved.
  • No immediate penalty: Owners will not have to pay a fine for simply receiving the NOD.
  • Future penalties: Failure to submit certifications in Cycle 2 and beyond can result in civil penalties of $1,500 for 1–3 family homes and $5,000 for all other buildings.

 

Options for Building Owners

1. Submit GPS2 for Cycle 2

After completing a Local Law 152 inspection, owners can file their Cycle 2 Gas Piping System Periodic Inspection Certification at dobgaspipecert.nyc.gov.

2. Submit a Challenge Request

If you believe you received the NOD in error, you have 30 days from the issue date to submit a challenge. This can be done through DOB NOW by navigating to the Safety module, selecting Violations, and filing a Challenge Request for Gas Piping.
